Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Documind platform and related services (the “Service”) operated by WENTZEL.AI (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account Terms

  • You must be at least 16 years old to use the Service.
  • You must provide accurate and complete information when creating your account and keep it up to date.
  • You are responsible for maintaining the security of your account credentials and API keys. We are not liable for any loss arising from unauthorised access to your account.
  • One person or legal entity may maintain multiple projects, but each account must represent a real individual or entity.

2. Use of the Service

The Service allows you to upload documentation, connect external data sources, and use AI-powered agents for customer support automation. You retain ownership of all content you provide (“Your Content”). By using the Service, you grant us a limited licence to process Your Content solely to operate and improve the Service.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload content that is defamatory, obscene, infringing, or otherwise objectionable.
  • Attempt to gain unauthorised access to the Service, other accounts, or related systems.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to develop a competing product or service.
  • Exceed published rate limits or abuse API access in a way that degrades the Service for other users.
  • Resell or redistribute the Service without our prior written consent.

4. AI-Generated Content

The Service uses Google Gemini AI to generate responses, triage tickets, and draft support replies. AI outputs are provided “as-is” and may not always be accurate or complete. You acknowledge that:

  • AI-generated responses should be reviewed before being sent to end users in production environments.
  • We do not guarantee the accuracy, completeness, or appropriateness of AI outputs.
  • You are solely responsible for how AI-generated content is used within your organisation and for any downstream consequences.

5. Billing & Subscriptions

  • The Service offers free and paid plans. Paid plans are billed on a recurring basis (monthly or annually) as described at the time of purchase.
  • AI usage is metered. If your usage exceeds the credits included in your plan, additional usage will be billed at the published overage rate.
  • All payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide pro-rated refunds for partial billing periods.

6. Intellectual Property

The Service, including its design, code, branding, and documentation, is the intellectual property of WENTZEL.AI and is protected by applicable copyright and trademark laws. You may not use our trademarks without prior written permission.

You retain all rights to Your Content. We claim no ownership over the content you upload or the AI-generated outputs produced from your data.

7. White-Label Usage

If you use the Service under a white-label or custom-branded configuration, you are responsible for ensuring that your branding and use of the Service complies with these Terms and applicable laws. You may not represent the underlying technology as your own proprietary creation.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

10. Termination

  • You may close your account at any time through the account settings or by contacting us.
  • We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or fail to pay outstanding fees.
  • Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow for export, after which it will be permanently deleted unless retention is required by law.

11. Limitation of Liability

To the maximum extent permitted by law, WENTZEL.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to indemnify and hold harmless WENTZEL.AI, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
